The website https://open.electrolux.com/ (the “Website”), owned and operated by Electrolux Italia SpA (“Electrolux”, “We” and “Our”), provides information on the Electrolux Booster Program project developed by Electrolux.

These terms of use (“Terms of Use”) sets forth the terms for your (“You”, “Your” or “User”) access and use of the Website. As long as You comply with these Terms of Use, We grant You a personal and non-exclusive right to access and use the Website. By using the Website, You agree to these Terms of Use. If You do not agree, do not use the Website.

We reserve the right to update these Terms of Use at any time, notifying the Users of the changes by publication on the Website. Your continued use of the Website following the posting of changes will mean that You accept and agree to the changes.

In addition to these Terms of Use, Your access and use of the Website, the Content (as defined below) and any services provided therein, including contests and competitions, will be governed by other applicable terms posted on the Website, including the Privacy Policy [LINK], the Cookie Policy [LINK], and the Terms for participation in the Electrolux Booster Program 2019 Call4Innovation competition [https://open.electrolux.com/boosterprogram2019]. The use of the Website, and related services, is only authorized in jurisdictions in which these Terms of Use and other applicable legal terms are legally valid.

Access and Use of the Website

You may use the Website for Your own personal, non-commercial use, provided that You:

• Comply with these Terms of Use and other legal terms referenced herein at all times;

• Do not use any scraping, robots, spiders or other automatic devices, programs, algorithms, methodology or processes, or use any other means not purposely made available through the Website, to access, copy, reproduce or circumvent the Website or its Content;

• Maintain appropriate security measures for use of the Website and the Content, including antivirus and firewall protection;

• Do not attempt to get unauthorized access to such features of the Website and the Content for which You are required to open a user account for use thereof;

• Are responsible for maintaining the confidentiality of the information You hold for Your user account, including Your password, and for any and all activity that occurs under Your user account as a result of You failing to keep such information secure and confidential. • Do not use the Website or its Content for any purposes that is unlawful or prohibited by these Terms of Use or in violation of good manners for use of the internet (“Netiquette”);

• If You upload any materials, where so specifically permitted as set forth on the Website, You will be fully liable for such materials, and Electrolux disclaims all liability for such materials to the fullest extent permitted under applicable law. Specifically You agree not to upload any materials that (a) may contain virus or other malicious code, or otherwise cause damage, (b) may infringe any third-party intellectual property rights or other similar rights, or (c) otherwise may be in violation of these Terms of Use. Electrolux reserves the rights to remove any materials uploaded by You for any reason determined by Electrolux in its absolute discretion. Users may report to Electrolux any materials considered illegal or inappropriate, in which case Electrolux may take appropriate actions.

In case of Your non-compliance with these Terms of Use or other legal terms referenced herein, Electrolux may block or terminate Your access to the Website and the Content. Further, Electrolux reserves the right to (a) to modify, suspend or terminate operation of or access to the Website and the Content, for any reason; (2) to modify or change the Website and the Content, and (c) to interrupt the operation of the Website, as necessary to perform routine or non-routine maintenance, error correction, or other changes.

Also for permitted personal, non-commercial use, You must respect Electrolux and/or its licensors’ ownership to the Website and the Content, including by not removing any copyright notices included therein or take other actions to hide or disguise such ownership, or purport that the Content is owned by You or any other unauthorized party.

Electrolux and/or its licensors shall always be entitled to take appropriate actions in relation to any unauthorized use of the Website and the Content. Any such unauthorized use may lead to civil or criminal actions under applicable law.

Warranty Disclaimer and Limitation of Liability

Electrolux does not warrant that the Website and the Content will be available at all times and that Your use thereof will be error-free or uninterrupted. The Website and the Content may be unavailable for various reasons, including failures in telecommunications networks and other circumstances for which Electrolux has no control. Electrolux will seek to minimize any operational interruptions of access to the Website and the Content (including any scheduled maintenance work), but will under no circumstances be liable for any such unavailability or other failures in the Website or the Content however caused.

Governing Law; Dispute Resolution

You agree that all matters relating to Your access to or use of the Website, including all disputes, will be governed by the laws of Italy, and be submitted to the exclusive jurisdiction of the courts of Milan, Italy unless otherwise follows from mandatory law.
